Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the TryTTS website and services at trytts.com (the "Service"), operated by Ihor Dudnyk, Empresário em Nome Individual, Nazaré, Portugal ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. Definitions

"Input" is any text or other material you submit. "Output" is the audio the Service generates from your Input. "Tokens" are the prepaid units the Service consumes (1 token per character synthesized).

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for your account credentials and for all activity under your account, including your API keys. Keep them secret; notify us of any unauthorized use.

3. Tokens, subscriptions and payments

The Service is prepaid. You buy tokens or a plan; synthesis and other paid actions consume your balance or subscription quota. Prices, taxes and available payment methods are shown at checkout and may change. Except where required by law or expressly stated, payments are non-refundable. Failed or reversed payments may lead to suspension.

4. Ownership and usage rights

We and our licensors own the Service and all related software and content. You retain the rights you already hold in your Input. Subject to these Terms and your having paid for it, we assign to you the rights we hold, if any, in the Output you generate, so you may use it for lawful purposes. You are responsible for ensuring your Input and use of Output do not infringe the rights of others.

5. Acceptable use

You agree not to use the Service to create or distribute content that is unlawful, fraudulent, defamatory, harassing, hateful, sexually exploitative of minors, that infringes intellectual-property or privacy rights, that impersonates others without consent, that spreads disinformation, or that facilitates scams, spam, or malware. You must comply with all applicable laws and with any rate limits or technical restrictions of the Service.

6. AI transparency

Output is synthetic audio produced by AI. Where you publish or distribute Output, you are responsible for making any AI-disclosure that the law or the relevant platform requires.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not warrant that Output will be accurate, original, uninterrupted, or fit for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or €100. Nothing limits liability that cannot be limited by law.

9. Indemnification

You agree to defend and indemnify us against claims, damages, and costs arising from your Input, your Output, or your breach of these Terms or of applicable law.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Provisions that by their nature should survive termination will survive.

11. Changes

We may update these Terms; material changes take effect when posted here or otherwise notified. Continued use after changes means you accept them.

12. Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-laws rules, and the competent courts of Portugal have jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
